These terms of service (“Terms”) are between You and Sun Life Assurance Company of Canada (“Sun Life”, “we”). These Terms govern Your use of the Sun Life Action on the Google Assistant service (the “Action”) on any Google Assistant-enabled device, like Google Home (each, a “device”). By using the Action, You agree to these Terms, as updated from time to time. Sun Life may change these Terms at any time, without notice to You. You should check these Terms often and if You do not agree to these Terms as modified, You must stop using the Action. You will be considered to have accepted any changed Terms if You continue to use the Action after the changes are posted.
These Terms apply in addition to and not in replacement of any other agreement or terms that apply to any other relationship that You have with Sun Life.
Balance Look Up
If You are a Sun Life client and you have certain types of coverage or accounts with Sun Life, the Action allows you to use voice commands to look up your balances.
To do this, you must use the Google Assistant mobile app to link to your Sun Life account and to create a four digit personal identification number (PIN) that you will speak aloud to authenticate each time you access the Action. Please be mindful when speaking your PIN aloud that others could overhear it and use it to access your Sun Life account using the Action. You are responsible for all access to your Sun Life account using the Action.
The Action uses software that was not developed by Sun Life and therefore, the Action may not operate correctly or provide you with correct balance information. The Action is provided for your convenience and Sun Life will not be responsible for any incorrect balance information obtained using the Action. The balance information available on mysunlife.ca will prevail over any inconsistent balance provided using the Action.
The Action allows You to use voice and typed commands to ask Sun Life to locate certain types of health care providers (“providers”) near You. You are solely responsible for all communications with Sun Life using the Action.
By identifying providers to You, Sun Life is not endorsing these providers. Sun Life does not recommend any provider over another. Provider ratings have been collected from Sun Life’s benefits plan members based on their own experience with that provider or that of their family members, and have not been validated by Sun Life. Members may rate providers more than once.
Sun Life receives contact and other information from providers as part of the claims process. Providers are responsible for accuracy of information provided through the claims process and direct billing registration. Sun Life is not responsible for the accuracy of this information.
Using a provider identified by this Action does not guarantee that any claim for reimbursement that You may make to Your Sun Life benefits plan will be approved. Your claims will be considered according to the terms of Your particular benefits plan.
Your use of the Action is voluntary. YOU ACCEPT ALL RISK IN YOUR USE OF THE ACTION. TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW, THE ACTION IS PROVIDED "AS IS" AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND SUN LIFE DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE ACTION, EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. SUN LIFE DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE ACTION, THAT THE FUNCTIONS CONTAINED IN, OR SERVICES PERFORMED BY, THE ACTION ARE CORRECT OR WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE ACTION WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE ACTION WILL BE CORRECTED. SHOULD THE ACTION PROVE INCORRECT OR DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL ASSOCIATED DAMAGES OR LIABILITY. SUN LIFE IS NOT RESPONSIBLE FOR ANY DAMAGE YOU MAY SUFFER FROM USING THE ACTION OR FROM ANY SERVICES PROVIDED BY PROVIDERS THAT ARE IDENTIFIED TO YOU BY THE ACTION. TO THE GREATEST EXTENT ALLOWABLE BY LAW, SUN LIFE WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR PERSONAL INJURY (INCLUDING DEATH), OR ANY DIRECT, INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, BUSINESS INTERRUPTION OR ANY OTHER DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO THE ACTION, SERVICES PROVIDED BY ANY OF THE PROVIDERS, ANY CLAIM THAT THE ACTION FAILS TO CONFORM TO ANY APPLICABLE LEGAL OR REGULATORY REQUIREMENT, CLAIMS ARISING UNDER CONSUMER PROTECTION OR SIMILAR LEGISLATION, YOUR USE OR INABILITY TO USE THE ACTION, OR FOR ANY CLAIM BY ANY OTHER PARTY, INCLUDING WITHOUT LIMITATION, PERFORMANCE OR NON PERFORMANCE OF OR ERRORS IN THE ACTION, LOSS OF USE, LOSS OF DATA HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (INCLUDING BREACH OF CONTRACT, TORT OR OTHERWISE) AND EVEN IF SUN LIFEHAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. These limitations will apply even if the above stated remedy fails of its essential purpose.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.
The Action is controlled and operated in Canada. These Terms are governed by the laws of the Province of Ontario, excluding its conflicts of law rules.
Google Inc. is an intended third-party beneficiary of these Terms.

You are not granted any right or licence to use any Sun Life trade-marks under these Terms.
