These terms of service (“Terms”) are between You (“You” and “Your”) and Sun Life Assurance Company of Canada (“Sun Life”, “we”). These Terms govern Your use of the Sun Life Skill on Amazon’s Alexa service (the “Skill”) on any Alexa-enabled device (each, a “device”). By using the Skill, You agree to these Terms, as they may be updated from time to time. These Terms apply in addition to and not in replacement of any other agreement or terms that apply to any other relationship that You have with Sun Life.
Sun Life may change these Terms at any time, without notice to You. You should check these Terms often and if You do not agree to these Terms as modified, You must stop using the Skill. You will be considered to have accepted any changed Terms if You continue to use the Skill after the changes are posted. Sun Life may also change, suspend, or discontinue the Skill, or any part of it, at any time without notice.
You can use the Skill to submit certain types of healthcare claims to Sun Life. Sun Life has the sole discretion to determine the type of claims that You can submit in this way
You are responsible for the claims information submitted using the Skill. Before You agree to submit Your claim, ensure that it is accurate. Otherwise, we may seek to recover any overpayments from You or take other steps to protect the Sun Life benefit plan (the “Plan”).
Fraudulent claims are very costly to Your Plan. For audit and investigative purposes, Sun Life may check the accuracy of the information given in support of Your claim, and if we ask, You agree to send us the original receipts and any other supporting documents within the time frame requested. Please keep Your original receipts and any other supporting documents for a period of 12 months.
- Sun Life reserves the right to remove this claim feature from the Skill and require that claims be submitted by paper claim form with original receipts and any other supporting documents.
Certification and authorization
When You submit a claim, You certify:
- that all goods and services being claimed have been received by me/my spouse/my dependents. If this claim is being made on behalf of my spouse and/or dependents, I am authorized to disclose information about them, and confirm they have authorized Sun Life to disclose information about their claims to me, for the purposes of assessing and paying a benefit, if any, and managing my group benefits plan.
- that the information in this form is true and complete and does not contain a claim for any expenses previously paid for by this or any other plan.
You also authorize Sun Life, its agents and service providers, and its reinsurers to collect, use and disclose information needed for underwriting, administration and adjudicating claims under this Plan to any person or organization who has relevant information pertaining to this claim including health professionals, institutions, investigative agencies, and insurers. I understand that information pertaining to this claim may be reviewed in the event that this Plan is audited.
Coverage & Account Information
If You are a Sun Life client and You have certain types of coverage or accounts with Sun Life, the Skill allows You to use voice commands to look up Your coverage information and balances, get status updates on recently submitted claims, and check the performance of Your workplace investments. To use the Skill, You will have to speak commands and questions aloud to Amazon’s Alexa service (“Alexa”), and You will receive responses aloud.
You must use the Alexa mobile app to link to Your Sun Life account and create a four digit personal identification number (PIN) that You will speak aloud to authenticate each time You access the Skill. Please be mindful when speaking Your PIN aloud that others could overhear it and use it to access Your Sun Life account using the Skill. You are responsible for all use of the Skill with Your PIN and for all of the interactions with Sun Life via the Skill.
Any communication to Sun Life via Alexa will be treated by Sun Life as a communication authorized by you, and any communication from Sun Life via Alexa in response to a request received from Your Alexa-enabled device will be treated by Sun Life as a communication to you. Sun Life is not responsible for any inaccuracies in Your interactions with Sun Life via the Skill.
The Skill uses software that was not developed by Sun Life and therefore, the Skill may not operate correctly or provide You with correct coverage information and balances, recent claims status, or workplace investment performance. The coverage and balance information, recent claims status, and workplace investment performance information available on mysunlife.ca will prevail over any inconsistent information provided using the Skill.
The Skill allows You to use voice commands to ask Sun Life to identify certain types of health care providers (“providers”) near You. You are solely responsible for all communications with Sun Life using the Skill.
By identifying providers to You, Sun Life is not endorsing these providers. Sun Life does not recommend any provider over another. Provider ratings have been collected from Sun Life’s benefits plan members based on their own experience with that provider or that of their family members, and have not been validated by Sun Life. Members may rate providers more than once.
Sun Life receives contact and other information from providers as part of the claims process. Providers are responsible for accuracy of information provided through the claims process and direct billing registration. Sun Life is not responsible for the accuracy of this information.
Using a provider identified by this Skill does not guarantee that any claim for reimbursement that You may make to Your Sun Life benefits plan will be approved. Your claims will be considered according to the terms of Your particular benefits plan.
Use of the Skill involves the electronic transmission of information across the networks of Your internet service provider or wireless service provider. Because Sun Life does not operate or control the internet or wireless networks used to access the Skill, Sun Life is not responsible for the privacy or security of internet or wireless data transmissions. Sun Life is not responsible for limitations and/or failures in performance associated with any wireless or Wi-Fi service used to access the Skill or for the security of any wireless or Wi-Fi service.
All use of the Skill is voluntary. YOU ACCEPT ALL RISK IN YOUR USE OF THE SKILL.
It is possible that the Skill may have bugs. In addition to the possibility of Alexa mishearing You or misquoting Sun Life, there’s also a possibility that something might not work correctly, or might not work at all.
Sun Life may or may not provide technical and other support for the Skill. You agree to abide by any support rules and policies. If such support is provided, it will be provided in addition to any normal support for Your Account(s).
TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW, THE SKILL IS PROVIDED "AS IS" AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND SUN LIFE DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SKILL, EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. SUN LIFE DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE SKILL, THAT THE FUNCTIONS CONTAINED IN, OR SERVICES PERFORMED BY, THE SKILL ARE ACCURATE OR WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE SKILL WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE SKILL WILL BE CORRECTED. SHOULD THE SKILL PROVE INCORRECT OR DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL ASSOCIATED DAMAGES OR LIABILITY.
SUN LIFE IS NOT RESPONSIBLE FOR ANY DAMAGE YOU MAY SUFFER FROM USING THE SKILL OR FROM ANY SERVICES PROVIDED BY PROVIDERS THAT ARE IDENTIFIED TO YOU BY THE SKILL. TO THE GREATEST EXTENT ALLOWABLE BY LAW, SUN LIFE WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR PERSONAL INJURY (INCLUDING DEATH), OR ANY DIRECT, INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, BUSINESS INTERRUPTION OR ANY OTHER DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO THE SKILL, SERVICES PROVIDED BY ANY OF THE PROVIDERS, ANY CLAIM THAT THE SKILL FAILS TO CONFORM TO ANY APPLICABLE LEGAL OR REGULATORY REQUIREMENT, CLAIMS ARISING UNDER CONSUMER PROTECTION OR SIMILAR LEGISLATION, YOUR USE OR INABILITY TO USE THE SKILL, OR FOR ANY CLAIM BY ANY OTHER PARTY, INCLUDING WITHOUT LIMITATION, PERFORMANCE OR NON PERFORMANCE OF OR ERRORS IN THE SKILL, LOSS OF USE, LOSS OF DATA HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (INCLUDING BREACH OF CONTRACT, TORT OR OTHERWISE) AND EVEN IF SUN LIFE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.
The Skill is controlled and operated in Canada. These Terms are governed by the laws of the Province of Ontario, excluding its conflicts of law rules.
Message and data rates may apply to Your use of the Skill.
You are not granted any right or licence to use any Sun Life trade-marks under these Terms. Sun Life trademarks and graphics used in connection with the Skill are the property of Sun Life Assurance Company of Canada. All other trademarks and graphics used are the property of their respective owners.
